Appellant, W. H. McDonald, who at the time this litigation commenced' was the treasurer of graded common school district Nó. 1, instituted this action against .B. E. Parker, county superintendent of common schools of Knox county for the purpose of obtaining a writ of mandamus requiring the appellee to pay over to him, as treasurer, the'sum of $1,470, which was' the pro rata of district No. 1 of the common school fund in his hands for distribution in Knox county for the school year 1906-07.
