Appeal from an order of the County Court of Schenectady County (Drago, J.), entered April 4, 2006, which denied defendant’s application to be resentenced under the Drug Law Reform Act of 2004.
In 2003, pursuant to a plea of guilty to criminal possession of a controlled substance in the first degree, defendant was sentenced to 15 years to life in prison. His conviction and sentence were affirmed by this Court on appeal (31 AD3d 800 [2006] , lv denied 7 NY3d 849 [2006]). In March 2005, defendant made an application to be resentenced under the Drug Law *985Reform Act of 2004 (L 2004, ch 738).…
