MEMORANDUM

URBOM, District Judge.

The petitioner herein, Larry E. Harris, is presently incarcerated in the Nebraska Penal and Correctional Complex; On June 1, 1970, this court entered an order permitting a petition tendered by Harris to be filed without prepayment of costs pursuant to 28 U.S.C.A. § 1915. At the same time the respondents were ordered to show cause within ten days why the writ should not be issued. In response to that order the respondents filed a return on June 10, 1970, requesting the application for writ of habeas corpus be denied and dismissed. This case will be decided on…
