MEMORANDUM OPINION
ALBRITTON, Chief Judge.
I. INTRODUCTION
This cause is before the court on a Motion to Dismiss (doc. # 4), filed by Defendant on August 15, 2001. Plaintiff Jimmy Atwell filed his Complaint with this court on July 24, 2001. Atwell brings a citizen suit seeking a declaratory judgment, in- junctive relief, penalties, and attorneys’ fees to enforce provisions of the Clean Water Act (“CWA”), 33 U.S.C. § 1251 et seq., the Alabama Water Pollution Control Act (“AWPCA”), Code Ala. § 22-22-1 et seq., and State Indirect Discharge (“SID”) permit no.
