Plaintiff was run down by an automobile of the defendant and sues him for damages.

Plaintiff avers that on August 16, 1922, at about 8 o’clock a. m., she was standing on the downtown river side of St. Charles and Eighth Streets seeking to cross St. Charles Street in the direction of the Lake; that she looked and listened before entering upon the asphalt roadway; that she saw an auto approaching about 400 feet away and believing that she would have time to cross started to do so; that before she had crossed an auto driven by the defendant E.
