Now before the Court is defendant McDonald Transit Associates, Inc.’s (“McDonald”) Motion for Partial Summary Judgment [40]. In response, Plaintiff Car-rol D. Roberson (“Roberson”), who is proceeding pro se in this cause, filed a Motion to Strike [43], in which he contends that McDonald’s motion should be stricken as untimely.1 The Court has reviewed these submissions, in conjunction with relevant evidence and authorities, and is now prepared to rule.
