In this juvenile delinquency proceeding respondent seeks "an order dismissing the proceeding for failure of the presentment agency to commence a dispositional hearing pursuant to the provisions of Family Court Act 350.1”. Respondent, on November 12, 1991, in Family Court, Suffolk County, pleaded *185guilty at fact finding to an act which if committed by an adult would constitute the crime of petit larceny, a class A misdemeanor (Penal Law § 155.25).
