ALLEN, Chief Judge.
The appellee, as plaintiff in the lower court, filed an action for divorce from the appellant-defendant alleging that the defendant was guilty of acts of desertion and acts of extreme cruelty; and that plaintiff should be granted a divorce and the real property, held as tenants by the entirety, should be declared the property of the plaintiff. The defendant answered denying the acts of cruelty and requested that the divorce not be granted.
