This is an application by the state engineer of the state of Utah for a writ of prohibition to restrain the defendants from exercising jurisdiction in respect to the distribution of the waters of Sevier river in Sevier county, Utah. Defendants demurred to the affidavit filed in support of the application. A brief statement of the material facts in narrative form will fairly present the questions to be determined.
