MacKINNON, Circuit Judge:

In a five-count indictment filed March 23, 1973, appellants, Sherpix, Inc., and its president Louis K. Sher, and seven codefendants, 1 were charged with violating federal and District of Columbia obscenity laws in connection with the distribution and exhibition of the film “Hot Circuit.” The first trial commenced September 24, 1973, and ended in a mistrial due to a hung jury.
