The applicant was, pursuant to the provisions of chapter 602 of the Laws of 1901, on May thirteenth, appointed commissioner of jurors in the county of Rings by a majority of the justices of the Appellate Division, in the second judicial department, in which department said county is situated, and, having duly qualified, he thereupon demanded of the respondent, who theretofore lawfully held the office of commissioner of jurors for said county and was then exercising the functions and performing the duties thereof, the possession of said “ office * * * and all the books and papers appertaining…
