The claim is for services rendered in piloting the respondent up the Delaware bay and river to Philadelphia. The tender and acceptance of the service, as well as its performance, is *166admitted by the answer. The refusal to pay is rested on an allegation that the libellant had no authority to perform the service, — that he was liable to indictment, under the laws of Pennsylvania, for performing it, and that the service was accepted in ignorance- of such want of authority.
