The application for the attachment was made ■upon the ground that the defendants were about to assign or dispose of their property, with intent to defraud their creditors. And the questions arising upon the affidavit of the plaintiff, which was presented in support of that application, are those of fact rather than of law. The debt upon which the application was founded, was stated to be for money paid out and advanced by the plaintiff, within the preceding five years, amounting to the sum of twenty thousand dollars, for the use and benefit of the defendants.
