The appellant was convicted of the murder of Roger E. Honeycutt and was sentenced to death. On direct appeal to this court, the underlying conviction for murder was affirmed; however, the death sentence was set aside due to defects in the instructions to the jury during the presentence hearing. See Stevens v. State, 242 Ga. 34 (247 SE2d 838) (1978) and its companion case Burger v. State, 242 Ga. 28 (247 SE2d 834) (1978).
