The purpose of this proceeding is to test the validity of the provisions of section* 155 (Art. 11) of chapter 10 of the Code of Ordinances of the city of New York, in so far as the same require the installation of an oil separator or similar appliance, as a condition precedent to the right of the owner or proprietor óf a garage to obtain a permit which will enable him to conduct the garage business, for the petitioners pray that a mandamus issue requiring the appellants to pass upon their application for a garage permit irrespective of whether or not they have complied with the…
