Appeal by the defendant, The New York Steam Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 13th day of July, 1901, upon the verdict of a jury for $2,000, and also from an order entered in said clerk’s office on the 5th day of July, 1901, denying the defendant’s motion for a new trial made upon the minutes.

The action is brought under the statute (Code Civ. Proc. § 1902 eb seq.) to recover for the death of John Koehler. The defendant is a domestic corporation, engaged' in supplying steam through its pipes laid in the public streets of the city of New York, to private consumers for mechanical power and for other purposes. At the time of the accident the defendant had a three-inch main in use along Nassau street, crossing Cedar street.
