THIS MATTER comes before the Court upon the parties’ cross-motions for judgment under Federal Rule of Civil Procedure 52, docket nos. 13 & 16.1 This action concerns the appeal of the denial of plaintiff Vicki Maher’s application for Short Term Disability and Long Term Disability benefits.
