In this nonjury case which is an action pursuant to section 167 of the Insurance Law of the State of New York to collect a judgment obtained by inquest by the plaintiff against one *1131Mercedes Fernandez in the sum of $6,198, formal findings of fact were waived.

Defendant Allstate Insurance Company had issued a policy of automobile liability insurance to Mercedes Fernandez but claimed that, prior to the accident which gave rise to plaintiffs cause of action, it had canceled it by mailing to her a notice of cancellation pursuant to section 313 of the Vehicle…
