Defendant was indicted on two counts of first-degree murder and one count of first-degree kidnapping. In a capital trial, the jury found defendant guilty of the first-degree kidnapping of Jose Celiz; guilty of the first-degree murder of Celiz on the basis of malice, premeditation, and deliberation, and under the felony murder rule; and guilty of the first-degree murder of Carlos Rodriguez under the felony murder rule using the kidnapping of Celiz as the predicate felony.
