[¶ 1] The Town of Hampden appeals the order of the Superior Court (Penobscot County, Kravchuk, J.) granting Sawyer Environmental Recovery Facilities, Inc.’s Rule 80B appeal from (i) a decision of the Hampden Zoning Board of Appeals affirming the Hampden Code Enforcement Officer’s (CEO) decision that two proposed landfill expansion projects constituted prohibited expansions of a nonconforming use; and (ii) a subsequent decision of the Hampden Planning Board that these projects cannot receive site plan approval based on the Zoning Board’s approval of the CEO’s land use determination.
