Basically, I disagree with the majority’s assertion, in the next to the last paragraph of the opinion, that “the testimony of all the witnesses leaves the evidence as to the ownership so evenly balanced that it cannot be said that a preponderance lies either way.”
That assertion is the cornerstone of the majority’s decision to remand the case to the chancellor for a decision about where the weight of the evidence lies.
