(concurring in part, dissenting in part)—I concur in the ultimate result of the majority opinion only to the extent of permitting the State of New York to maintain jurisdiction of the child custody issues in this case. I dissent from that portion of the majority opinion which approves declination of jurisdiction over the remain*394ing issues and awards substantial attorney's fees to Nicole Shaw.
