MONROE, J.
This is an action in damages for personal injury sustained by plaintiff, who, whilst driving across defendant’s railway tracks on St. Charles avenue at the intersection of Marengo street was run into by one of defendant’s cars, with the result that his wagon was overturned, and one of his legs was so badly crushed as to necessitate amputation.
