In April 2008, the housing court CPLR article 12 guardian ad litem (GAL) of respondent, Feng Chai Lin, entered into a stipulation to settle this holdover proceeding. The stipulation provided that respondent would vacate by July 31, 2008, in return for some money. Respondent, now represented by counsel and with the help of a new GAL, moves to vacate the April 2008 stipulation. After a hearing, this court finds that respondent never agreed to the settlement.
