This was an action of debt, on a bond dated September 6, 1808, conditioned that Philbrook, a prisoner in the jail in Wiscasset, at the suit of Patterson, should continue a true prisoner, &c. The' action was commenced on the 21st day of December, 1808; and at the September term of this Court, in 1810, the parties agreed to the following case, viz.: “ That the bond was duly executed by the defendants; that after the execution of the bond, the said Philbrook went into a certain workshop, which was wholly owned, and which stood on ground wholly owned, by one Thomas M’ Crate where, in the daytime…

Andrew Philbrook, on the 6th of September, 1808,
when this bond was executed, being then a prisoner in the jail at Wiscasset on the plaintiff’s execution, became so far enlarged thereby as to be entitled to the “ liberty of the prison-yard in the daytime ; but not to pass without the limits of the prison,” &c.
