This case has its origin as far back as June, 1848, at which date the plaintiff in error sued out an attachment from, the Cook county Court of Common Pleas, as creditors of Augustus E. Miller and David R. Clements, against the estate of said Miller and Clements, and instructed the defendant in error, then sheriff of Cook county, to levy the same on a stock of dry goods and groceries, and a store in Chicago, of the value of three thousand dollars, or thereabouts, and which stock and store were claimed by one Jacob Miller as his property, but which the defendant in error was directed by Graydon…
