hOn 22 June 2010, the state filed a bill of information charging the defendant, Eugene C. Brown (“Brown”), with possession •with intent to distribute heroin, a violation of La. R.S. 40:966 A. On 24 June 2010, he pleaded not guilty. On 20 August 2010, a hearing on the motions was held; the trial court found probable cause and denied the motion to suppress the evidence.
