delivered the opinion of the court:

This is a suit for the difference in the pay and allowances of a captain and a second lieutenant from February 3, 1942, to May 5, 1942, and the difference between the pay and allowances of a captain and a first lieutenant from May 6, 1942, through February 14, 1945.

Gerald C. Stillman, deceased, accepted appointment as a second lieutenant in the Field Artillery Eeserve on June 7, 1941, entering on active duty June 11, 1941. He served in that rank and in the grade of first lieutenant from May 6, 1942, until his death on September 7, 1944, as…
