Appeal from, Polk District Court — Hon. S. F. Balliet, Judge. Action in equity, to set aside certain curbing and paying assessments, and the certificates issued thereon. Decree for defendants, and plaintiff appeals.

I. Prior to 1885, John A. Elliot owned the north fractional half of section 1, in township 78, range 24, west fifth p. m. Thereafter, the state fair grounds were located east of the city of Des Moines, and, for the purpose of affording ready access to the same, the board of supervisors, of Polk county, in 1885, established Gfrand avenue, as a consent road, one hundred and sixty feet wide, through said land.
