In this contested probate proceeding the proponent moves for the dismissal and the striking out of the objections of the contestant, Josephine C. Sutton, and the notice of appearance filed on her behalf by her attorney. The application is based upon the contention that the contestant was not related to the testatrix, was not one of her next of kin and, therefore, lacks a legal status to contest the will.
