WOODS, Circuit Judge.

The citation in this case was issued September 15, and made returnable October 14, 1896. On the ensuing 39 th the judge who signed the citation made a nunc pro tunc order, as of the 14 th, extending the time for filing the record to October 24, 1896. Two days before the expiration of that time, the plaintiff in error caused the case to be docketed in this court, and on the next day a motion to dismiss the writ of error, because the case was not docketed in time, was filed.
