This is an application under article 78 of the Civil Practice Act for an order “ commanding the New York State Employees’ Retirement System and J. Raymond McG-overn, State Comptroller, as the Administrative Head of the New York State Employees’ Retirement System, to accept, process and approve Petitioner’s application for an Accidental Disability Retirement Allowance under the terms of Section 79 of the Civil Service Law, and to pay to Petitioner the said allowance due to him pursuant to subdivision e of Section 79 of the said Law.”
