The plaintiff appeals from a judgment in the district court which rejected his demand for damages in an action in tort, and dismissed his suit.

The demand arose out of an accident which occurred on July 26, 1944, at about 3:50 p.m., on the Plank Road just north of the city limits of the City of Baton Rouge at the moment he was travelling north on his motorcycle and the defendant, Dudley J. Bourgeois, had been going south in his Ford 4-door sedan.
