This was an action of assumpsit, in the Superior Court of Cook county, against appellant as a common carrier. The cause was tried by the judge without a jury, and damages assessed to the full amount of the plaintiff’s claim, and for which judgment was rendered.

To reverse this judgment the defendants appeal.

It appears from the bill of exceptions that appellants own a line of freight cars plying between the Atlantic seaboard and the west, carrying freight at the same tariff of charges the railroad companies do, whose tracks they use. Their only business is that of freighters. They have an…
