MasoN, Judge:

At the May term, 1915, of the circuit court of Marshall County, Grover Littleton was indicted, charged with having broken and entered the store room of M. B. Fisher, in Mounds-ville in said county, on the - day of February, 1915, with the intent to steal the goods and chattels of said Fisher then in said building, and that he did steal certain goods, amounting in the aggregate to six dollars and twenty cents. The defendant was arrested, moved to quash the indictment, which motion was overruled. He then pleaded not guilty. At the same term of court he was tried, convicted, and…
