Tbis was an application for a mandamus to compel tbe treasurer of tbe city of Milwaukee to issue a tax deed. It is not denied that tbe application is sufficient, unless tbe non-compliance with tbe requirements of chapter 113, Laws of 1867, which appears on tbe face of tbe relation, is a sufficient reason for refusing tbe writ. It is not denied that it would be a good reason, if that act is applicable to tbe certificate on which this deed is claimed.
