On January 28, 1926, the State Bank of Pullman, as plaintiff, brought suit in assumpsit against Gregory H. Hovnanian in the circuit court to recover the amount of principal and interest claimed to be due from the defendant to the plaintiff on a promissory note, payable on demand, for the principal sum of $3,200. A declaration, containing the consolidated common counts and a count in the usual form on the note in question, payable to the order of the bank, was filed by the plaintiff.
