MEMORANDUM OPINION

CHURCHILL, District Judge.

This case, which involves two physicians as opposing litigants, arises directly out of a medical malpractice action that is pending in Saginaw County Circuit Court. Before filing the state malpractice claim in which plaintiff Michael Johnson named Dr. Roger Kahn as a defendant, Johnson’s attorney, Loren Gray, contacted Dr. Sheldon Burman to obtain an evaluation of the presence or absence of malpractice on the part of Dr. Kahn and other potential defendants.
