Plaintiff, as the administratrix of the estate of her deceased husband, John Dunlap, *218sued to recover damages for the death of her husband which she alleges was caused by the negligence of the defendant. A trial before a jury resulted in a verdict for plaintiff in the sum of sixty-five hundred dollars, but afterward the court sustained a motion for a new trial on the ground “that the court should have peremptorily instructed the jury to return á verdict for the defendant,” and the cause is before us on the appeal of plaintiff.
