Alexander Dykes v. State of Maryland No. 70, September 2014 Term Criminal Procedure - Right to Counsel - Discharge of Appointed Counsel. When a trial court finds that an indigent defendant has a meritorious reason for discharging appointed counsel, the discharge of counsel is not itself a waiver of the right to counsel. The trial court must advise the defendant of the right to, and advisability of being represented by, counsel and appoint new counsel, if the indigent defendant requests representation.
