This case comes before the Court on Defendant Yamaha Motor Manufacturing Corporation’s (“YMMC”) motion for leave to file a motion to determine the substantive law of this case [69].

This is a products-liability action over which the Court has diversity jurisdiction pursuant to 28 U.S.C. § 1332. Plaintiffs Peter and Maureen McCarthy are Austra*1331lian citizens.
