Appeal by the defendant, John Wanamaker, from a judgment of the Supreme Court in favor of the plaintiff entered in the office of the clerk of the county of New York on the 17th day of April, 1911, upon the verdict of a jury for $3,500, and also from an order entered in 'said clerk’s office on the 21st day of April, 1914, denying defendant’s motion for a new trial made upon the minutes.

Shortly after two o’clock in the afternoon on the 23d day of December, 1912, the plaintiff, who was then eighty years of age, was in the defendant’s department store at Broadway and Ninth street in the borough of Manhattan, New York, for the purpose of shopping. After purchasing some articles at a lace counter which ran northerly and southerly, she proceeded to pass between the end of the counter and swinging doors leading into the store from Broadway, on her way to an aisle running easterly and westerly along the Ninth street side of the store, and while so doing she was struck…
