OPINION OF THE COURT

SCIRICA, Circuit Judge

This immigration case concerns whether Gurpreet Singh’s conviction under 35 P.S. § 780-113(a)(30) was an aggravated felony under the Immigration and Nationality Act (INA), which would make him ineligible for discretionary relief from removal from the United States. We will grant the peti tion for review, vacate the opinion of the Board of Immigration Appeals (BIA), and remand to the BIA for further proceedings.
