Parker, a resident of Chicago, 111., brought an action against the defendant board of county commissioners to recover the purchase price of certain tax certificates alleged to have been illegal, together with subsequent taxes indorsed thereon, and recovered a judgment. Thereafter, and after the term in which the judgment was rendered, defendant filed its petition to vacate the judgment for fraud in its procurement.
