State v. Payne

I respectfully dissent because I am of the opinion that State v. Berg, 383 N.W.2d 7 (Minn.Ct.App.1986) cannot be adequately distinguished. I would reverse and hold that the trial court erred in suppressing *277evidence found on Payne after what I perceive to be a lawful search.
