This action was instituted to recover from the defendant, Garvin county, moneys collected by its county treasurer as special assessments, interest, and penalties levied and assessed against the lands of one William George Paul, a Chickasaw Indian, whose lands were not at the time taxable, and not legally liable for such special assessments, on account of a provision in the Atoka Agreement which rendered such lands nontaxable as long as the…
