delivered the opinion of the Court.
In the County Court of Lauderdale County George Brown, appellant, and his wife, Cora Brown, were convicted of assault and battery upon Arthur Clark under an indictment returned by the. grand jury in the Circuit Court, charging t-liem with assault and battery with intent to kill and murder him. On motion of the prosecuting attorney the case was transferred to the County Court for trial, where conviction was had, as stated supra.
