*1123In April 2006, plaintiff Eileen Kennedy (hereinafter plaintiff) allegedly sustained injuries when she tripped over twisted rebar near a fence as she walked across property owned by the City of Kingston, Ulster County. About two years earlier, defendant had installed the fence pursuant to a contract with the City. Plaintiff, a City employee who was working at the time of the accident, and her husband, derivatively, commenced this action against defendant.
