COLEMAN, Justice.

This is an appeal from the judgment of the 61st District Court granting appellee recovery on a promissory note executed by appellant as part of a property settlement agreement. This agreement was approved by the District Court of Nueces County, Texas, and was incorporated into the judgment of that court in Cause No. 59455-A, which granted appellee a divorce. It is the contention of appellant that the note was alimony and, therefore, unenforceable.
