In the above case I concur with the judgment of the court, but do not concur in the reasons given by the court. In this case at the time of the institution of this suit the title to the town site of Wagoner, in the Creek Nation, still remained in the Creek Nation, and in my judgment said town site was then under the same laws, rules, and regulations as Indian country, and the underofficers of the Secretary of the Interior, under the laws of the United States and treaties with the Creek* Nation, and the rules of the department, were authorized to compel non-citizens doing business in said…
